Herodicus - Terms of Service

effective from 1 September 2026 · version 1.0 (beta) · wersja polska

§1. General provisions

1. The web application Herodicus (the “App”), available at herodicus.pl, is used for keeping a food diary and planning meals and workouts.

2. The service provider is Przemysław Fiega, operating as an unregistered business activity (działalność nierejestrowana) under Article 5 of the Polish Entrepreneurs’ Law, contact: kontakt@herodicus.pl (the “Provider”).

3. Using the App requires acceptance of these Terms and the Privacy Policy.

4. The App is in beta - it is under active development and individual features may change.

5. This English version is provided for convenience. In case of any discrepancy, the Polish version prevails.

§2. Account and requirements

1. Creating an account requires an e-mail address, a first name and a password (min. 10 characters). The account is free of charge.

2. The App may be used by persons aged 16 or over.

3. You agree not to share your account with third parties and to protect your password. You may delete your account at any time by contacting the Provider.

§3. Scope of services - what is free and what is paid

1. Free, without time limit: the food diary, targets and profile, your own dish library, the shopping list, the workout module and a daily pool of free AI analyses (the current amount is shown in the App).

2. For credits: AI-powered features beyond the free pool - meal analysis from a photo or description, the “Precise” mode, generation of diet and workout plans, dish suggestions from your shopping list. The current price list in credits is always shown in the App next to each feature.

3. The App contains no advertising and does not require a subscription.

§4. Credits

1. Credits are the App’s internal units of account. They can be received as bonuses (e.g. a welcome bonus) or purchased in packages whose prices are shown in the App in Polish złoty (gross).

2. Credits do not expire, cannot be exchanged for money and cannot be transferred to another account.

3. A credit is charged only for a successfully completed AI operation. If an analysis or generation fails, credits are returned to your account automatically.

4. Payments are processed by an external payment provider (Stripe). The Provider does not store payment card data.

5. Right of withdrawal: credits are added to your account immediately after payment. By making a purchase, a consumer expressly requests the immediate crediting of the credits (performance beginning before the withdrawal period expires) and acknowledges that, once the credits are credited, the right of withdrawal is lost - in accordance with Article 38(1)(13) of the Polish Consumer Rights Act, implementing Directive 2011/83/EU. This consent is collected and confirmed during the payment process.

6. Section 5 does not limit your rights under the complaint procedure (§7). In particular, credits charged for failed operations are returned automatically, and in justified cases (e.g. an accidental purchase reported before any credit from the package has been used) the Provider may issue a refund voluntarily.

§4a. Optional subscription

The optional subscription costs PLN 29.99 gross per month and includes 650 credits. The first payment is collected at purchase; subsequent payments renew automatically each month on the date shown in Stripe. Credits are added after successful payment. Paid credits do not expire and remain available after cancellation. A zero credit balance never triggers an additional charge.

You can cancel future renewals through the Stripe portal linked from the credits screen or request cancellation at kontakt@herodicus.pl before the renewal date. Cancellation does not limit statutory consumer rights or complaint rights. A failed payment does not grant another credit allocation.

§5. Informational nature - important

The App does not provide medical, dietetic or therapeutic services. Nutritional values calculated by AI (calories, macronutrients) are estimates and may differ from reality. Diet and workout plans are for information and education only and do not replace advice from a doctor or dietitian. If you are ill, take medication, are pregnant or have special dietary needs - consult your plans with a doctor. Do not use the App to treat eating disorders.

§6. Rules of use

1. The following is prohibited: creating accounts to obtain bonuses fraudulently, attempts to circumvent limits, automated querying of the App, actions disrupting its operation, and using AI features for purposes unrelated to the App’s intended use.

2. The Provider may restrict or block an account that violates these Terms; in case of a block, unused purchased credits are refunded proportionally, unless the violation consisted of fraud.

§7. Complaints

1. Complaints may be submitted to kontakt@herodicus.pl. The Provider responds within 14 days.

2. Consumers may use out-of-court dispute resolution, including the EU ODR platform: ec.europa.eu/consumers/odr.

§8. Liability and availability

1. The Provider makes every effort to keep the App running continuously; however, as a beta service, it may be temporarily unavailable (maintenance, failures, limitations of third-party providers, including the AI model provider).

2. The Provider is not liable for dietary or health decisions made on the basis of the App’s estimated data (§5), nor for damage resulting from false information provided by the user.

§9. Changes and final provisions

1. The Provider may amend these Terms for important reasons (changes in law, features, supplier prices). Users will be informed in the App 14 days in advance; changes do not apply retroactively to credits already purchased.

2. Matters not covered here are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the Act on Providing Services by Electronic Means. Mandatory consumer protection rules of your country of residence remain unaffected.
